In 2014, two Oregon college students spent hours on a wholesome winter activity: building a snow sculpture.

But as they rolled their creation across campus, they misjudged the slope of the landscape. The snowball picked up speed, veered off course and crashed into a dormitory, knocking in part of a wall. No one was hurt, but the outcome was far from what they planned. What started as a controlled, creative effort turned into something unintended and destructive.

Hidden AI bias can unfold the same way. A small modeling choice—a skewed dataset, a mislabeled input, a design shortcut—can gain momentum quietly. And if it’s not caught early, that bias can shape decisions at scale.

In privacy programs, where accountability for data use is a legal requirement, that kind of unchecked drift creates risk that can be difficult to control.

What is hidden data bias?

Bias in AI is the ultimate snowball effect, the result of compounding decisions over time. It can originate in early data selection, annotation practices or the objectives chosen during development. And much like a snowball can become an avalanche, hidden biases can shift how models behave once deployed. Here are a few things to watch for:

• Data Representation: Training datasets that underrepresent certain populations can skew model outputs. This can happen when data is pulled from narrow sources or reflects past exclusion.

• Labeling Decisions: Human annotators bring their interpretation to subjective data. This can result in inconsistent or inaccurate labeling, especially in categories like emotion, risk or intent.

• Design Tradeoffs: Developers make modeling choices based on goals, such as minimizing false positives or reducing processing time. These tradeoffs can result in outcomes that favor convenience over equity.

• Historical Carryover: Models trained on real-world data absorb the dynamics of the past. If those patterns reflect inequitable access, discrimination or systemic gaps, the model may perpetuate them.

How can AI bias impact data privacy programs?

AI bias directly impacts how personal data is classified, processed and acted upon—especially in high-risk applications like hiring, lending, healthcare and behavioral profiling. When trained on flawed datasets, these systems can lead to discriminatory outcomes that potentially violate privacy laws or expose gaps in your data governance practices.

Here are core pressure points where biased AI systems can introduce compliance risk:

• Fairness And Discrimination: Under the EU’s General Data Protection Regulation, personal data must be processed lawfully, fairly and transparently. Biased AI outputs can run afoul of these principles. In the U.S., laws like the California Consumer Privacy Act don’t have a general fairness requirement but limit the use of sensitive personal information and allow control over certain types of automated processing.

• Profiling And Automated Decisions: A growing list of states—including Colorado, Connecticut, Virginia and Montana—require businesses to let consumers opt out of profiling that leads to legal or similarly significant effects. California doesn’t offer this opt-out directly but allows consumers to limit how sensitive data is used.

• High-Risk AI Requirements: AI laws are becoming more prevalent. The EU AI Act now categorizes AI systems by risk level, with “high-risk” systems—like those used in employment, finance or education—subject to mandatory assessments, documentation and oversight. Similarly, both Colorado and Utah have enacted AI acts that require businesses to consider AI risk levels.

• Transparency And Trust: Opaque AI systems make it harder to explain how personal data is used, eroding trust and limiting individuals’ ability to exercise their privacy rights.

What are some steps businesses can take to detect and mitigate AI bias?

As scrutiny increases, regulators focus on how organizations document and mitigate the risks of algorithmic decision making. If you’re using personal data to automate choices about people, your processes need to demonstrate both technical diligence and legal awareness.

These are practical steps for reducing bias and meeting evolving regulatory expectations:

1. Conduct privacy impact assessments.

As required under GDPR (Article 35) and some U.S. state laws, PIAs can evaluate how AI systems handle personal data, where bias may occur and how risks should be avoided or managed. They’re especially important when:

• Introducing new vendors, services or products

• Launching tools that use data to build profiles or make decisions

• Modifying data flows that impact individuals

2. Understand your vendors.

Are you doing enough due diligence for your AI tools? Ask your AI vendors for documentation on their training data sources, how they use your data, how they evaluate bias during development and what internal review processes are in place.

If they can’t explain how their model reaches a decision or if they use your data for their own purposes, it’s a liability waiting to happen. If you move forward with an AI vendor, your contract should include AI-specific terms that require transparency, bias mitigation, data protection practices and advance notice of major system changes.

3. Audit your AI regularly.

AI is an incredibly dynamic tool. Outputs change over time as they ingest new data. Build in regular assessments—not just for accuracy, but for fairness, privacy impact and consistency with user rights. This is especially important for systems making high-impact decisions about people.

4. Track emerging AI regulations.

Whether it’s the EU AI Act, Colorado’s Consumer Protections for Artificial Intelligence Act or new state-level profiling rules, the regulatory environment around automated decision making is accelerating. Make sure your privacy and product teams align with upcoming obligations and documentation requirements.

5. Fine tune your privacy notices.

If AI tools and the data you collect intersect, your privacy notice needs to reflect that. Explain whether data is used in automated decisions, what data is involved and how individuals can exercise their rights. If you’re using third-party tools, say what data they access and for what purpose. And update your notice regularly—especially when systems change. Your notice may be the only explanation users get, so make it count.

Bias doesn’t have to be obvious to be a problem—it just has to go unchecked. In AI systems, those early missteps scale fast, especially when personal data is involved. The sooner your team builds in the right checks, the easier it is to stay compliant and in control.
